LADIES AND GENTLEMEN,
I am most pleased to address you on this occasion of my swearing in as the Governor of our dear Ekiti State. I am quite aware that you are fully informed of the series of events culminating in the programme, which we have just witnessed. For the past few months, Ekiti State has gone through a lot of uncertainties and trauma. As the true representatives of Ekiti People the House of Assembly has carefully and diligently followed the due process in the impeachment culminating in the removal of Dr. Ayo Fayose and Mrs. Biodun Olujimi, Governor and Deputy Governor of Ekiti State respectively. This action has been taken in the overall interest of all Ekiti people.
The impeachment of the former Governor and his Deputy has demonstrated the independence of the House of Assembly, which is the representative of the people. If anything too, it has proven beyond any reasonable doubt that Ekiti, our dear State, is greater than any individual. Her interests are paramount.
As the State begins a new journey under this administration, I enjoy you all to join hands with me in ensuring that we have a State, which we will all be proud of.  All the noticeable vices, which are alien to Ekiti, will no longer be promoted or encouraged.  I also appeal to our people who are aggrieved to take succor in the fact that we now have a new beginning, which is not polluted by the past. Together, we can and should have Ekiti of our dream.
Distinguished Guests, Ladies and Gentlemen, I cannot end this address without sounding a note of warning to trouble makers. The strong arm of the law will be brought to bear on such people. The next three months will be used to douse the tension, which the past years have engendered.
Ladies and Gentlemen, what is important at this trying period is a genuine advice that is aimed at reconciling our people and charting the course of true development in Ekiti State. This administration will not be at home with any advise or suggestion that is self-seeking or aimed at destroying innocent people.
As an inclusive government, this administration welcomes everybody on board. Let us rise beyond petty considerations. This administration promises to run an open-door government where the aspirations of everybody will be fulfilled.
I thank you for your support for this course while asking for God’s blessing on Ekiti and its people.

FAYOSE, OLUJIMI REMOVED, RT. HON. ADEREMI SWORN IN(16/10/2006)
It was jubilation galore in Ekiti yesterday as indigenes of the state from all the 16 local government areas thronged the state capital to express their support to the lawmakers on the impeachment of the governor.
            The Speaker of the House of Assembly, Rt. Hon. Friday Aderemi has been sworn-in as acting Governor of Ekiti State following the removal of Governor Ayodele Fayose and his Deputy, Chief (Mrs.) Biodun Olujimi by the Ekiti State House of Assembly.
Fayose was the Governor of Ekiti State for three years, five months and 16 days while Mrs. Olujimi was deputy governor for eight months and nine days, having been sworn in on December 7, last year.
The Speaker of the Assembly, Rt. Hon. Friday Aderemi, has assumed office as governor. He is expected to occupy the seat for three months after which there will be a by-election to elect a new governor.  Speaking after taking the oath of Office and allegiance as the Ekiti State Number one citizen in Ado-Ekiti, Hon. Friday Aderemi said his major preoccupation in the next 3 months was to abuse tension that had heightened in Ekiti State in the last 3 years.
            Governor Aderemi who was sworn-in by the State Acting Chief Judge, Justice Aladejana promised to run an open door administration adding that everybody will be carried along in the decision-making process.  He appealed to all aggrieved people in the State to see the new dispensation as a new beginning.
The new governor, in his speech after the swearing-in, urged the people to rally round his administration, which he called a corrective regime.  Aderemi noted that the impeachment of the former governor was a demonstration of the independence of the House of Assembly, saying it was obvious that the lawmakers in the state were not in support of any corrupt leader.  He warned those who might want to foment trouble to have a rethink of their stand, saying that law enforcement agencies were ready to deal with any anarchist.
          Among the dignitaries present at the swearing-in ceremony is the Ekiti State Head of Service, Elder Segun Bankole, Permanent Secretaries and Directors from various Ministries in Ekiti State with the panel members that indicted Dr. Ayodele Fayose and Mrs. Abiodun Olujimi guilty.  Traditional Rulers present included the Ewi of Ado-Ekiti, the Onijan of Ijan Ekiti, the Onisan of Isan Ekiti and the Alayetoro of Ayetoro Ekiti. Also present are the state party chairman, Chief Ropo Adesanya; the former deputy governor to Fayose, Chief Abiodun Aluko, Senator Clement Awoyelu and the former chairman of Ado-Ekiti local government, Taye Fasubaa. Others are members of the House of Representatives, all the 23 out of 25 lawmakers and other notable Ekiti people.
It was also on notice that the big status on the rostrum and the portrait of Dr. Ayo Fayose was absent from where it was hung before beside President Olusegun Obasanjo.
The old Governors Office, Ado-Ekiti was filled to the capacity with people of proven integrity in Ekiti State to admire the new Governor.
 
REPORT OF THE INVESTIGATION PANEL OF SEVEN PERSONS APPOINTED BY HONOURABLE JUSTICE JUBRILL B.K. ALADEJANA ON THE ALLEGATIONS OF ACTS OF GROSS MISCOUNDUCT LEVELED AGAINST THE EXECUTIVE GOVERNOR OF EKITI STATE. DR. AYODELE FAYOSE DATED 16TH DAY OF OCTOBER 2006
Report of the Report of the investigation panel of seven persons appointed by Honourable Justice Jubrill B.K. Aladejana on the allegations of acts of gross misconduct leveled against the Executive Governor of Ekiti State - Dr. Ayodele Fayose.
Introduction:  Pursuant to section 188 (5) of the 1999 Constitution of the Federal Republic of Nigeria, this panel of seven persons was set up by Honourable Justice Jubril B.K. Aladejana on Friday, 13th October 2006.
The seven persons are:

Venue:  Ekiti State House of Assembly Complex Ado-Ekiti
Rules of procedure:  Pursuant to section 188, subsection 7(a) of the constitution of the Federal Republic of Nigeria, 1999 the Ekiti State House of Assembly prescribed the Rules of procedure which are 23 in number, hereinafter referred to as “the Rules”.
This panel in compliance with section 188 (7) (a) of the 1999 constitution of the Federal Republic of Nigeria 1999 exercised its powers and functions in accordance with the Rules.
Notices:  Notices of sittings duly signed by the Chairman of the Panel were dispatched to all the parties concerned viz:-  (i) The Speaker of the House,  (ii) The Executive Governor of Ekiti State – Dr. Peter Ayodele Fayose and  (iii) The Deputy Governor of Ekiti State – Chief (Mrs.) Abiodun Olujimi.
Commencement of sittings:  Relying on rule 4 of the Rules, the Panel commenced its sitting on 13th October, 2006 at 10.30a.m.
Attendance:  The legal Representatives of the House of Assembly and Deputy of Governor of Ekiti State Rowland Otaru, SAN, with Gboyega Oyewole, Tayo Aluko, Akintude Esan, and Joseph Omodele Adewumi Esquire respectively.
Absent:  The Executive Governor of Ekiti State, Dr. Peter Ayodele Fayose and his legal representative were absent.
Witnesses:  Ekiti State House of Assembly called three witnesses and closed its case. The witnesses were viz:-
(a)        M.P. Ogele, Esquire, a private legal practitioner and National Coordinator of Ekiti State Equity, Justice and Peace Movement.
(b)       Abubakar Aliyu Madaki, Deputy Superintendent of Police attached to Economic and Financial Crimes commission. (EFCC).
(c)        Mr. Gbenga James, Managing Director, Biological Concepts Limited, Afao-Ekiti, Ekiti State and Avian Specialties Nigeria Limited, a close friend of Dr. Ayodele Fayose.
These witnesses were cross-examined by the legal representative of Her Excellency, Chief (Mrs.) Abiodun Olujimi.
The Executive Governor – Dr. Peter Ayodele Fayose and his witnesses failed to appear before the panel but forwarded his response to the 7 allegations of gross misconduct against him. The Deputy Gov., Chief (Mrs) Abiodun Olujimi called no witness. Her legal representative rested her case on the House of Assembly.
Addresses:  Learned counsel to the Deputy Governor Joseph Omodele Adewumi Esquire addressed the panel followed by learned counsel to the House of Assembly, Rowland Otaru, SAN, with Gboyega Oyewole, Tayo Aluko and Akintunde Esan.
Close of proceedings:  After the addresses of the aforesaid learned counsel, the proceedings of the panel was declared closed on 14th day of October, 2006, when it became obvious that the Governor of Ekiti State – Dr. Peter Ayodele Fayose would not attend the panel sittings.
Report:
Dr. Peter Ayodele Fayose, The Executive Governor of Ekiti State.
After careful consideration of the evidence of the witnesses for the Ekiti State House of Assembly which was unchallenged by the Executive Governor, the panel hereby reports thus:-
Allegation One:
Illegal Operation of Foreign Accounts contrary to paragraph 3 of the Code of Conduct for public officers to wit.
Operation of foreign account with the Bank of Africa, United State of America with VISA CREDIT NO 45397806 and 28083056 valid until August, 2007, contrary to the provisions of paragraph 3 of the Code of conduct for Public Officers.
Evidence:  Olatunji Adegoke, Personal Assistant to the Executive Governor, Dr. Peter Ayodele Fayose in whose custody the credit card No. 45397806 was found made confessional written statement to the Economic and Financial Crime Commission on 24th day of July 2006 to the effect that the aforesaid credit card belonged to Dr. Peter Ayodele Fayose. The statement was tendered in evidence by EFCC representative. A copy of the Visa credit of the Bank of America U.S.A. valid until August 28 with the signature of the Executive Governor, Dr. Peter Ayodele Fayose, was also received in evidence. The evidence was unchallenged.
Verdict:  Guilty  
Allegation Two:
Illegal Operation of Foreign Account Contrary to paragraph 3 of the Code of Conduct for Public Officers to wit:
Operation of Foreign accounts Nos: 50633925, 60642924 and 808909594 kept with Barclays Bank Plc. 38, Hans Crescent Knightsbridge, London, SWL XOLZ contrary to paragraph 3 of the Code of Conduct for public officers.
Evidence:  The EFCC tendered a copy of the Premier Bank Account of Barclays Bank Plc, 38 Hans Crescent Knightsbridge, London with account No 50633925 and Account Name Mr. Ayodele Fayose and same was received in evidence. This evidence was unchallenged.
Verdict:  Guilty
Allegation Three:
Illegal diversion of Local Government Funds contrary to Section 162 of the Constitution of the Federal Republic of Nigeria 1999.
Diversion from the Ekiti State Joint Local Government Account the sum of N11.7 Billion received from the Federation Account from January 2004 to June 2006.
Evidence:
There are overwhelming evidence to the effect that various sums of money from the Ekiti State Joint Local Government Account were diverted to illegal quarters. The evidence were uncontroverted.
Verdict: Guilty
Allegation Four
Receipt of illegal gifts contrary to paragraph 6 of the Code of Conduct to wit:
Receipt of the sum of ₤37,000.00 (Thirty Seven Thousand Pounds sterling only) from the Biological Concepts Ltd. Knowing it to be the proceeds of the Poultry Project embarked upon by the State Government.
Evidence:
Mr. Gbenga James, The Managing Director of Biological Concepts Ltd. Gave evidence before the Panel that out of the money for the Integrated Poultry Project he gave ₤37,000 (Thirty Seven Thousand Pounds sterling) to Adegoke Olatunji the Personal Assistant to the Executive Governor, Dr. Peter Ayodele Fayose on the instruction of the Executive Governor.
Verdict: Guilty
Allegation Five:
Receipt of the illegal gift contrary to paragraph 6 of the Code of Conduct to wit:-
Receipt of a house lying and being at 10 Kobiowu Crescent, Iyaganku, GRA, Ibadan Oyo State valued at over N40 million built from the proceeds of the poultry project.
Evidence:
Evidence was led by the prosecution to show that there was an agreement between Mr. Gbenga James, the Managing Director of both Biological Concepts Ltd. and Avian Specialties Ltd. And the Governor to build a building worth 40 million at Ibadan from the proceeds earmarked by the State Government for the poultry project.
Mr. Gbenga James gave evidence that the building drawn by Grid Associates was actually built at 10 Kobiowu Crescent, Iyaganku G.R.A. Ibadan, Oyo State valued N40 million being part of the money earmarked by the State Government for the poultry project.
The building plan of the said building was tendered through Mr. Gbenga James by the prosecution.
Various documents to corroborate this evidence were tendered and received in evidence.
Verdict: Guilty
Allegation Six
Receipt of illegal gifts of two houses contrary to paragraph 6 of the Code of Conduct to wit:-
i.          Property lying and being at 23, Ring Road Restaurant Street, Behind Total Petrol Station, Iyaganku, GRA, Ibadan, Oyo State valued at about N20 million built from the proceeds of the contracts of Ekiti State Governor’s Office awarded to Grid Associates headed by Abiodun Fari-Arole.
ii.         Property lying and being at Are Road, Afao-Ekiti State valued at about N25 million built from the proceeds of the contracts for Fountain Hotel awarded to Grid Associates headed by Abiodun Fari-Arole.
iii.         The sum of N42 Million collected from Mr. Abiodun Fari-Arole of Grid Associates through Mr. Ayobola Abiola, then of the Standard Trust Bank Plc, now with FCMB Plc, Dugbe Branch being proceeds of the contract for Fountain Hotel and Governor’s Office.
Evidence:
This allegation was substantiated with unchallenged oral documentary evidence tendered by the EFCC and Mr. Gbenga James, the Managing Director of Biologicawl Concept Ltd. and Avian specialties Ltd.
Verdict: Guilty
Allegation Seven:
Illegal transfer of the sum of $100,000 to the United State of American contrary to the money laundering act 2004.
Transfer of the sum of $100,000 to the United State of America on 20th August, 2004 through Account No 45703770 of City Bank, 244, Mani Street, White Palms NY 10601 belonging to Mr. Toney Orubuloye contrary to the money laundering Act, 2004.
Evidence:
The EFCC representative gave evidence that Abiola Ayobola of Zonal Head-West First City Merchant Bank Ibadan transferred a sum of $100,000 dollars to the United States of America on 20th August 2004 through account No 45703770 of City Bank, 244, Mani Street, White Palms NY 10601 belonging to Mr. Toney Orubuloye for the benefit of His Excellency Governor Ayo Fayose and personal staff who reportedly ran out of cash in United State of America.
This evidence was unchallenged.
Verdict:  Guilty.
Conclusion:
In view of the available evidence before the Panel, the Panel came to the conclusion that all the aforementioned allegations of acts of gross misconduct against the Executive Governor of Ekiti State. Dr. Peter Ayodele Fayose have been proved.

WITNESSES: Ekiti State House of Assembly called three witnesses and closed its case.  The witnesses were viz:
(a)        M.P. Ogele, Esquire, a private legal practitioner and national Coordinator of Ekiti Justice and Equity movement.
(b)       Abubakar Aliyu Madaki, a deputy Superintendent of Police, attached to Economic and Financial Crimes Commission (EFCC).
(c)        Mr. Gbenga James, Managing Director, Biological Concept Limited, a close friend of Dr. Ayodele Fayose.
dollars) from his secretary when she was on her way to London on the instruction of the Executive Governor, Dr. Ayodele Fayose.
            However, in her response to the allegation of acts of gross misconduct, which her counsel adopted as her defense to the allegation, she stated therein that she collected the said sum for remission to Mr. Osinowo a friend of Mr. Gbenga James, for a project.
            However, Mr. Tunde Osinowo in his written statement to the EFCC on 6th February, 2006 denied knowing anything about a landed property and that the Deputy Governor, Chief (Mrs.) Abiodun Olujimi never brought any Dollars to him.  He denied having any land dealing with Mr. Gbenga James and Mrs. Olujimi.  This evidence was unchallenged.
VERDICT: In view of the unchallenged evidence before the Panel that Chief Mrs. Abiodun Olujimi, Deputy Governor of Ekiti State received a sum of $50,000 (Fifty Thousand Dollars) from the secretary of Mr. Gbenga James, being part of the money earmarked for the Poultry Project coupled with the fear that Chief Mrs. Abiodun Olujimi failed to appear before the Panel to clarify the whereabouts of the said sum of fifty thousand dollars, this Panel has no option than to come to the conclusion and hereby come to the conclusion that Chief Mrs. Abiodun Olujimi was the beneficiary of the said sum of money.  She is found GUILTY.
ALLEGATION TWO: Failure to comply with the Decree establishing the National Youth Service Corps Scheme, which mandates all holders of certificates equivalent to a  bachelor’s Degree to observe a one year compulsory Youth Service Programme.
EVIDENCE: The Ekiti State House of Assembly adduced no evidence before the Panel in proof of this allegation.
REPORT: As there is no evidence before the panel upon which the panel can write a report, the Panel hereby holds that this allegation is deemed abandoned by the Ekiti State House of Assembly and is hereby stuck out.

REPORT OF THE INVESTIGATIVE PANEL INTO ALLEGATIONS OF GROSS MISCONDUCT AGAINST HIS EXCELLENCY, THE EXECUTIVE GOVERNOR OF
EKITI STATE, DR. PETER AYODELE FAYOSE AND HIS DEPUTY
CHIEF (MRS.) BIODUN OLUJIMI.
INTRODUCTION
The Ekiti State House of Assembly in accordance with section 188 (5) of 1999 Constitution of Federal Republic of Nigeria requested the Honourable Chief Judge of Ekiti State vide a letter dated the 26th September, 2006 to set up a Seven (7) man panel to investigate allegations of gross misconduct against the Executive Governor of Ekiti State Dr. Peter Ayodele Fayose (hereinafter referred to as the Governor) and his deputy, Chief (Mrs.) Biodun Olujimi (hereinafter referred to as the Deputy Governor).
           The Chief Judge of Ekiti State in accordance with relevant provisions of the same 1999 Constitution inaugurated the Seven (7) man panel on the 10th of October, 2006.  The names of the Seven-man Panel are as follows.
1.         Mr. Remi Bamigboye                             -            Chairman

3.         Mr. Sesan Adesuyi                                -            Member
4.         Rev. Segun Da-Silva                              -            Member
5.         Chief Olu Alade                                     -            Member

7.         Mrs. Olufunmilayo Olukogbon               -            Member
            All the members of the panel were sworn in on the 10th of October, 2006 at the High Court premises,  Ado – Ekiti.
OBSERVATION
            Immediately after the swearing in ceremony, the Panel sat at the High Court number 2 at Ado Ekiti.  The Panel made its inaugural sitting with the counsel representing the Governor in attendance.  It should be noted that neither the Ekiti State House of Assembly nor its counsel made any appearance before the Panel on the 10th of October, 2006.  The Panel thereafter adjourned its sitting till 12th of October, 2006 by 9.00am to enable the Ekiti State House of Assembly to present its case against the Governor and His Deputy.
            Meanwhile, the Panel wrote a letter to the Speaker to enable the Ekiti State House of Assembly, being the petitioner appears before the Panel today, the 12th of October, 2006.
            The Panel states that the Chief Judge of Ekiti State has obliged the Panel a copy of allegation as contained in the notice of impeachment against the Governor and his Deputy.
The chairman called on the Ekiti State House of Assembly to open its case.  The Panel observed that neither Ekiti State House of Assembly nor its legal representatives were present.  The Panel thereafter adjourned till 01:00pm to deliver its report.
REPORT
The conclusions of the Panel is that having regard to Section 36 of the 1999 Constitution of the Federal Republic of Nigeria and the sensitive nature of the allegations against the Governor and his Deputy, and failure of the Ekiti State House of Assembly to appear before the Panel, the Panel concluded that all the allegations of gross misconduct against the Governor and his Deputy as contained in the notice of impeachment dated 26th of September, 2006 are deemed abandoned by the Ekiti State House of Assembly.
It is trite that, he who alleges must prove beyond reasonable doubt in criminal allegation as it is in this case.  The allegations are therefore unsubstantiated, gold digging and therefore failed in its entirety.  This Panel hereby absolves the Governor and his deputy of all the allegations contained in the notice of impeachment.
 
BRIEF ON THE SEVEN-MAN INVESTIGATION PANEL SET-UP BY THE HONOURABLE CHIEF JUDGE OF EKITI STATE ON ALLEGATION OF GROSS MISCONDUCT AGAINST THE EXECUTIVE GOVERNOR OF EKITI STATE DR.PETER AYODELE FAYOSE AND HIS DEPUTY CHIEF MRS. ABIODUN OLUJIMI.
Section 188(5) of the 1999 Constitution of the Federal Republic of Nigeria vested the Chief Judge with power to constitute a panel of seven persons of unquestionable and impeccable integrity that will investigate acts of gross misconduct against the executive Governor of Ekiti State and his Deputy. This is based upon a request originating from the Rt.Hon Speaker of Ekiti State House of Assembly.
This panel was consequently constituted and made public on Monday 9th October 2006 by His Lordship Rt.Hon.Kayode Bamisile.After a critical consideration of the list by members of the Ekiti State House of Assembly, the list was unanimously rejected for non-conformity with the aforesaid provisions and a likelihood of  bias based on the following facts.
1.         MR REMI BAMIGBOYE:-  He was named the Chairman of the panel .He is a native of Erio-Ekiti, the hometown of Mrs.Feyisetan Fayose the wife of the Executive Governor of Ekiti State. In fact, he is a brother/cousin of the Governor’s wife.
2.         MR. SEGUN DA SILVA IGE:- An unknown character from Igbemo-Ekiti, who is also known to be a close and childhood friend of Governor Fayose.
3.         MR ALI APANISILE:-  A native of Ikere- Ekiti, who is only four years old at the bar and a very junior Lawyer in the Chambers of Barrister Duro Ajayi who until a few months ago suspended by the Attoney General and Commissioner for Justice in Ekiti State .
4.         MR SESAN ADESUYI:- A native of Afao – Ekiti, the hometown of Governor Ayo Fayose. He is equally a cousin to the Governor and a Brother to the Wife of the Chief Press Secretary to Governor Fayose. Adesuyi is a close school and old classmate to Prince Akin Olayisade at Ekiti Parapo College Ido –Ekiti. Prince Akin Olayisade is currently the Chairman SUBEB Ekiti State and the closest friend to Governor Ayo Fayose.  He stole pipes at the ESWC for which he was disciplined.
5.         MRS FUNMILAYO OLUKOGBON:-  She is from Epedo in Edo State, a registered contractor with Ekiti State Government and a very close and childhood friends of Mrs Feyisetan Fayose wife of the Executive Governor of Ekiti State.  Dismissed from UAC foods last year for fraud.
6.         CHIEF OLU ALADE- A native of Igede Ekiti,who retired some few months ago from Civil Service of Ekiti State as a Permanent Secretary under a questionable circumstances. He was known to have fraudulently falsified his years of services by two years. To this end, government has consequently approved to make payment of his pension and gratuity on his old status as a Director rather than on Permanent Secretary-ship cadres to serve as punishment.
7.         MR SOLOMON AJISAFE:- A relatively unknow person whose antecedent cannot be traced to anywhere in Ekiti State Ship particular and Nigeria in general.
       In summary, out of the seven members appointed by His Lordship, three of them are from Irepodun/Ifelodun Local Government Area of Ekiti State, which is the Local Government of the Executive Governor being investigated; two are his wife’s relation and associate (a brother and a friend) and  one other appointee, a nominee of Prince Akin Olayisade, the closest friend to Governor Fayose.
Since His Lordship has deliberately violated section 188 (5) of the 1999 Constitution of the Federal Republic of Nigeria, by refusing to appoint persons of impeccable integrity and honour on the panel, but rather appointing close friends and relations of the Executive Governor and his wife. The Ekiti State House of Assembly hereby reject the list of His Lordship appointees without any reservation with immediate effect.

3.         VOTE OF NO CONFIDENCE ON THE C.J.
Whereas the Ekiti State House of Assembly through its resolution has directed the C.J. of Ekiti State to inaugurate a panel of seven persons to investigate allegations of gross misconduct leveled against the Executive Governor of Ekiti State, His Excellency Dr. Peter Ayodele Fayose and his Deputy, Her Excellency Chief Mrs. ’Biodun Olujimi.
Whereas the panel appointed should consist of persons of unquestionable character pursuant to section 188 (5) of the 1999 Constitution of the Federal Republic of Nigeria.
Whereas the C.J. of Ekiti State Justice Kayode Bamisile inaugurated a panel of seven persons that raised dust from various quarters of Ekiti State on the ground that members so appointed are of questionable integrity.
Whereas the C.J. of Ekiti Justice Kayode Bamisile collected the sum of N15 million naira out of the N25 million allegedly collected as legal fee by Chief Niyi Akintola (SAN) for grafting an ‘ex-parte’ motion against the EFCC.
Whereas the C.J. of Ekiti State Justice Kayode Bamisile willfully refused to allow one Lateef Fagbemi (SAN) counsel to the Ekiti State House of Assembly to collect court processes on the suit filed by Governor Ayo Fayose and his Deputy Mrs. Biodun Olujimi against the House of Assembly.
Whereas punitive transfer of the Court official that eventually made the court
processes available to Mr. Lateef Fagbemi (SAN) was carried out by the C.J.
Whereas the C.J. has violated Section 188 (5) of the constitution by appointing
persons of questionable integrity to the impeachment panel.
Whereas the C.J.  authorized the impeachment panel to start proceedings without
complying with the appropriate procedure in fact, they did not come to the House of Assembly to pick up the procedure.
We are supposed to give them to guide their activities as prescribe by section
188 (7) of the Constitution.
Whereas Justice Kayode Bamisile collected money and vehicle from  Governor
Ayo Fayose two days ago under the pretext of providing accommodation and transport to the impeachment panel and the impeachment panel is supposed to be the baby of the House of Assembly. We are supposed to provide them accommodation, feeding and even the venue where they are to sit not the Executive Arm of Government that has a case to answer. So, the man acted contrary.
Mr. Speaker, members of Ekiti State House of Assembly, whereas Justice Kayode Bamisile willfully disrespected this Honourable House of Assembly by refusing to appear before this House of Assembly this morning to justify the appointment of persons of questionable characters he appointed on the impeachment panel.
Now, therefore be it resolved and it is hereby received by this Honourable House
of Assembly of Ekiti State that a vote of no Confidence is hereby passed on the C.J. of Ekiti State, Hon. Justice Kayode Bamisile and he is suspended as the C.J. of Ekiti State forthwith with immediate effect and should appear before the House Committee on Judicial maters for further investigation.

APPOINTMENT OF JUSTICE JIDE  ALADEJANA AS THE ACTING C.J. OF THE STATE.
MOTION MADE
Whereas having derived our power the suspension of the C.J. Section 128 and 129 of the constitution of the Federal Republic of Nigeria and having put up a panel to try him that is the House Committee on Judiciary.
There is need for somebody in the State Judiciary to hold forte while he is on suspension and while he is appearing before the investigation panel, in this vein, I want to move that Justice Jide Aladejana of the Ekiti State Judiciary should hold forte and perform the duties of the office of the C.J. of Ekiti State to avoid a vacuum pending the outcome of the report of the investigative Committee of the House .

Whereas the Executive Governor of Ekiti State, His Excellency Dr. Peter Ayodele Fayose had been duly served with the notice of allegations of Gross misconduct pursuant to section 188 (1) and (2) of the 1999 constitution of the Federal Republic of Nigeria.
Whereas the House of shall resolve by motion without any debate whether or not the allegation should be investigated pursuance to section 188(3) of the 1999 Constitution of the Federal Republic of Nigeria.

Whereas, the House shall resolve by motion without any debate whether or not the allegation should be investigated pursuance to section 188 (3) of the 1999 Constitution of Federal Republic of Nigeria.
NOW THEREFORE be it Resolved and it is hereby Resolved by this Hon.
House of Assembly that the Chief Judge of Ekiti State Appoint a  panel of 7 persons to investigate the allegations of gross misconduct against the Deputy Governor of Ekiti State, Her Excellency Mrs. Abiodun Olujimi.

CALLING ON THE ACCOUNTANT GENERAL OF EKITI STATE TO STOP ALL TRANSACTION AND BANK WITHDRAWAL
MOTION MADE
That the Accountant General of Ekiti State should with immediate effect stop all withdrawals from Banks where Ekiti State Government keeps account. All instruments, cheques, bills that are in transit should be dishonored and stopped and all expenditure from the consolidated revenues should equally be stopped with immediate effect.
