FAYOSE REPLIES THE IMPEACHMENT NOTICE

Ekiti State Governor Ayo Fayose dropped his defense yesterday to reply to the impeachment notice served him by the House of Assembly.  He submitted his reply with a promise to abide by the decision of the seven-man panel to be inaugurated today by the Chief Judge, Justice Kayode Bamisile.
Gov. Fayose, who arrived at the Assembly complex at about 11.20a.m, was accompanied by his Deputy, Chief Mrs. Biodun Olujimi and other top government officials. He submitted his reply to the Deputy Clerk of the House, Mr Tunde Famoyegun at the Conference Hall of the complex.
Describing his impeachment travails as traumatic and painful, Fayose warned that nobody should take to the streets because of him.  Anybody who has no business at the venue of the sitting of the impeachment panel should stay away, he said.  According to the Governor, the lawmakers, 24 of whom are pushing for his removal, are exercising their constitutional powers to have served him and his deputy the impeachment notices. He was at the House of Assembly to tender his reply as a mark of respect for the Constitution, the Governor said.
Gov. Fayose described the unfolding political drama as "unprecedented" in the political and constitutional history of Nigeria as, according to him, it is the first time a governor and his deputy have been placed on the impeachment guillotine.
He also asserted his innocence on all the charges levelled against him, describing himself as a man of history whose travails are the price of leadership.  His words: "In the history of man, a journey like this will serve as an experience. If you have a beautiful bed, you must buy a mat, for a situation may arise that you will need the mat.  "I am a man of destiny; my destiny cannot be changed. The Assembly, by the powers conferred on it, is exercising its constitutional duties. What is happening is a price of leadership and I have come to respect the Constitution and formally give a reply.
"My reply explains all the situations and it is not for me to be a judge in my own case. My future and that of all the Ekiti are in the hands of God, I am innocent of all the allegations.  History is being made; it is the first time that a governor and the deputy governor are served with impeachment notices (at the same time) and I want to assure all the Ekiti that though the situation is traumatic and painful, nobody should take to the streets or take on anybody because of me."
Mrs Olujimi also asserted her loyalty to her boss, saying she was accompanying the governor to the House since the lawmakers had sent impeachment notices to the duo.  In her brief remark, she said, “I have come with you (Fayose) since it is a joint ticket and since the indictment, we have been together.”

DETAILS OF THE REPLY TO THE IMPEACHMENT NOTICE.

I am aware that under the constitution of Nigeria the code of conduct tribunal is the only body empowered to try public officers for the infraction of the law on the running of foreign account and in my case I have no such case before the tribunal nor was I ever found guilty of such contravention by the tribunal.
However for the records, on allegation one (1), I don’t have any current operational account in the Bank of America, United States of America.  The Visa Credit No 45397806 and No. 28083056 are not known to me as stated in the paragraph one (1) of the notice.
On allegation two (2) the account Nos. 50633925 and 60604224 mentioned are no longer operational as claimed and were declared on my assumption of office.  Please note that account No. 80809594 is not known to me.
(3) Illegal diversion of Local Government Funds contrary to section 162 of the constitution of the Federal Republic of Nigeria, 1999.
Answer:
This allegation is spurious and contains no iota of truth.  I did not divert the sum of N11.7 billion out of N17.8 billion received from the federation account from January 2005 – June 2006 from the state account.  The notice failed to mention which account was diverted.  All allocations from the Federation account comes straight into the Local Government Joint Account, and as the governor of the state, I oversee the disbursement of the funds with the stipulated guidelines of the accounting procedure.  In a small state as ours no governor or individual can divert N11.7 billion without serious negative repercussions on the financial running of the state.  Government is equally not run by the governor alone.  Details of Local Government spending and transactions are with the Accountant General’s office and will be produced upon request.
(4) Receipt of the illegal gifts contrary to paragraph 6 of the Code of Conduct to Wit:
Answer:
This allegation is false and baseless.  I did not receive the sum of E37,000 from anyone or Biological Concept who are handlers of the poultry project of Ekiti State.  My personal assistant has denied collecting the said money on my behalf in this statement of July 24, 2006 to EFCC.
(5) Receipt of the illegal gifts contrary to paragraph of the Code of Conduct to Wit:
Answer:
This allegation is also false and I did not receive any illegal gift of the house lying situate at No 10 Kobiowu Crescent Ibadan as gift arising from the proceeds of the Ekiti State Poultry Project.
(6) Receipt of the illegal gifts contrary to paragraph of the Code of Conduct to Wit:
Answer:
This allegation is also false.  I did not receive the property lying at No 23 Ring Road Restaurant Street, Ibadan, valued at 20 million Naira as a gift. It is not true that I received any gift from the proceeds of the Governor’s office contract awarded to Abiodun Fari-Arole, by extension, Grids Associates Nigeria Ltd.  The said property was build from proceeds on my legitimate earnings.  I wish to state that I was not a pauper before becoming the Governor of Ekiti State in May 2003, as all these allegations are orchestrated to bring me and my government down.
(ii) the property lying and being at Are Road, Afao Ekiti, Ekiti State valued about 25 million Naira  in my country home belong to me.  I started building the house before I became governor of Ekiti State in 2003, and was given to Mr Abiodun Fari-Arole for completion.  He was paid for his services by cash and not paid from the proceeds of contract of Fountain Hotel.   The said property is not a gift to me I have never received any gift of gratification from Grid Associate or Abiodun Fari-Arole.  The fact that Fari is an Ekiti contractor does not prevent me not to.
(iii) I did not collect 42 million Naira directly or indirectly through Mr. Ayobola from Mr. Abiodun Fari-Arole of Grids Associates as illegal gift being proceeds from the contract of Fountain Hotel and Governor’s office.  Abiodun Fari-Arole lives in Ekiti and sees me daily and needs not go through any third party to deal with me if at all he uses to.
Ayobola Eniola does not represent my interest at all.  Our relationship is strictly official as he serves as a Banker to the State Government and nothing more.  Though I have known him as a casual friend for a while before becoming a governor.
(7) Illegal transfer of the sum of $100,000 to the United State of America contrary to the Money Laundering Act 2004.
Answer:
In reply to paragraph 7, I state categorically, that the allegation is false.  I did not transfer the sum of $100,000 to the United States of America on the August 20, 2004 through Account No 45703770 of City Bank or at any time.

Receipt of Illegal gifts contrary to Paragraph 6 of Code of Conduct to Wit.
Deputy Governor, Chief (Mrs.) Olujimi explains thus:
Allegation (i)  Receipt of $30,000 from Secretary of the Managing Director, Biological Concepts Ltd knowing same to be proceeds of the poultry by the Ekiti State Government.
Answer:
This allegation is false. Let me state that I have know Mr. James for some time before the incident as my friend and bosom friend of His Excellency the governor who is my boss as at the date in question I was a member of the House of the Representatives in Abuja.
Mr. James had called me that day over a personal and private business of his and had asked that since I was traveling to meet my family in Lagos en-route Ibadan to please help him by getting to his office to pick the money to his friend in Lagos.  I eventually did, and met a dark, pregnant lady who I know to be his secretary but who was not very used to me.
She confirmed her boss’s instruction to do same but maintained that she needed proof that she done the right thing.  I told her it was not my duty to write a note for such and that she should do same.  The writing on the note that was eventually found at Mr. James’ office is that of the secretary I signed knowing all the implications of signing for a bribe or an inducement of knowing that Mr. James had no reason to induce or bribe me.
I do not and cannot in any way know that the cash was drawn from the Biological Concept accounts as I accepted cash only.  I was asked to give the money to his friend, Mr. Oshinowo for a project.  It cannot have been a bribe because is would not in anyway have signed for myself or on behalf of anyone, knowing the implications there in.  It was s simple errand, which was duly acknowledged by Mr. James.  Mr. James has at different times given me letters to absolve me of any complicity or knowledge of a crime or implication of bribery.  The photocopies of the letters are attached.  Mr. James had no reason to bribe me as I was not in anyway connected with the poultry project.  When it was conceived, neither file nor communication ever passed through me while I was an aideto the governor.  When it was being executed, I had moved to the Federal House of Representatives.  I also have no influence in anyway on the project of an the governor as it was handled by the former Deputy Governor, Mr. Abiodun Aluko, who was not my boss but a superior officer that I had very little interaction with.
Allegation 2: Failure to comply with the Decree establishing the National Youth Service Corps Scheme, which mandates all holders of certificates equivalent to Bachelor’s Degree to observe a one year compulsory Youth Service programme.
Answer:
This allegation is also false sir, Section 177 of the Constitution is very clear on this issue sir,  It states miter alia: a person shall be qualified for election to the office of Governor (or Deputy Governor) of a state if he is a citizen of Nigeria by birth, he has attained the age of 35 years; he is a member of a political party and is sponsored by that political party.  He has been educated up to at least School Certificate level or its equivalent; I obtained a Diploma at The Nigeria Institute of Journalism (NUJ) in 1976 and as at then, the institution was not included in the NYSC participation, I would have otherwise loved to serve my fatherland as requested of me.  I submit that I am qualified based on the constitutional requirement and provision and that does in anyway require qualification(s) that make participation mandatory.  In all sir, let me state that this issues are already part of a court process that has been filled.  I thank you for the opportunity to explain issues.

DON’T TRAMPLE ON THE CONSTITUTION
- Impeachment notice yet to be served
The government of Ekiti State has been constrained to bring to the notice of the general public and relevant judicial bodies the following flagrant abuses of due process in the impeachment notice purportedly served on the Governor and the Deputy Governor of our dear State by the Ekiti State House of Assembly.
  1. That as at today, the 1st of October, the duo of the Governor and Deputy Governor are yet to be served the impeachment notice which has already been circulated and celebrated in the media, even though they have endeavoured to start putting up their defenses, based on the newspaper publications to forestall the ambush of the normal process.
  2. That there is a palpable fear that the due process as prescribed by the section 188 of the constitution is about to be breached by one Mr. Madaki who is the IPO on the Ekiti case as he is quoted to have said that the process would be hijacked and completed on or before Friday 6th October.
  3. That it is public knowledge that the EFCC has promised to install the Speaker and the Majority leader as Governor and the Deputy Governor respectively, hence the mysterious disappearance of the Mace without the knowledge of the Clerk of the House of Assembly.
  4. That it is envisaged that paragraph 3 is due to the fact that the EFCC and their collaborators have mandated the honourable members to sit outside the State of jurisdiction which is an infringement of the standing order of the House of Assembly Rules which stipulates that plenary sessions should take place on the floor of the House and not at any hideout.
  5. That we are not afraid of impeachment process but, that the rule of law and due process of impeachment, which guarantees fair hearing, must be respected.
  6. That this novel idea of impeachment at EFCC offices and hideouts is strange and unknown to the constitution of the Federal Republic Nigeria and is inimical to the democratic processes. If unchecked, the country will be turned into a Gestapo country, and who knows the next victim?
  7. That the public should take note of the strange trend whereby the legislators in collusion with the EFCC can be covetous of the seat of the executive, a panacea for confusion and ultimate anarchy.
  8. That the Governor and Deputy Governor remain innocent until proved otherwise.
  9. That the President, the National Assembly, the Chief Justice of Nigeria, the Inspector General of Police, the Nigeria Bar Association, all Security agencies, the EFCC, the indigenes of Ekiti State and the general public should please note.

PRESS STATEMENT BY HIS EXCELLENCY DR. PETER AYODELE FAYOSE GOVERNOR OF EKITI STATE TO THE PEOPLE ON MONDAY 14TH  AUGUST, 2006.
Gentlemen of the Press,
It is with a very heavy heart that I address you today. Today is one of the darkest in the simmering trend of events in Ekiti State in the recent past. My Government have had causes to express serious worry and concern on the conduct of some characters, who do not see anything good in this government and the ruling party; who have adopted a brazing desperation as a tool  for capturing power.
They have, as you and I have noticed, mounted mindless and ferocious battles, of violent prone dimensions, in this state. Hitherto, Government had ensured that the unwholesome activities and destructive tendencies of these elements were contained in a manner that they do not degenerate into blood letting.
My heart therefore bleeds this day as I receive the shocking news of the gruesome murder of Dr. Ayodeji Daramola, an emerging light in the present generation of Ekiti indigenes. I knew Dr. Ayodeji Daramola as a fine gentleman, an astute intelligentsia and a lover of the progress of Ekiti State. He was the first Project Manager of the Ekiti State Community Based Poverty Reduction Agency (EKCPRA). He worked assiduously in bringing the Agency from the scratch to the limelight.
Fellow compatriots, let me assure you that no stone will be left unturned in saving this state from the evil, callous and barbaric machinations of desperate individuals and coalitions whose agenda is to turn Ekiti State into a battle field. Enough is enough. At this stage, I enjoin all concerned to eschew violence in the face of this dastardly and provocative act.
The question is who killed this gentleman, Dr. Ayo Daramola? This is a mystery that must be unravelled instantly. The President, Commander – In – Chief of the Armed Forces, the Inspector-General of Police and the echelon of the Security Agencies are already aware of this unfortunate incident which is coming on the heels of the yet-to-be-resolved murder of another PDP governorship aspirant and stalwart in Lagos State, Chief Funso Williams. It is clear that the intention of these bloodhounds is to cause a spate of general insecurity across the length and breadth of Nigeria.
As Chief Security Officer in this State, I shall spare no effort in ensuring the protection of lives and properties in Ekiti State.  As I speak to you, all hands are on deck to unravel the identities of these cowardly murderers whoever and wherever they are. The Ekiti State Government shall reward any person or group of persons who can assist in providing useful clues into unraveling this mystery with a cash reward of five million naira (N5.0M).
I sincerely commiserate with the family of Dr.Ayodeji Daramola at this dark moment. I commiserate with the good people of Ijan-Ekiti and indeed the Chairman and entire people of Gbonyin Local Government Area. May those who murdered Dr. Ayo Daramola never know peace all their lives. May the sword of destruction never depart from their homes. May their own children and children’s children never know the pigmentation of their skin nor the warm embrace that parenthood offers.
May the good Lord grant sweet repose to the soul of Dr. Ayodeji Daramola as the Government and people of Ekiti State mourn him.

EKSG DISBURSES N30M LOAN TO SOCIETIES (09/08/06)
Ekiti State Government has disbursed a total sum of Thirty Million Naira (N30m) to nineteen societies and unions across the state out of the One Hundred Million Naira (N100m) earmarked for the Ekiti Credit Finance Scheme.  The State Governor, Dr. Ayodele Fayose presented the cheque to the beneficiaries at the New Governor’s Office, Ado-Ekiti recently.
The Governor who said that the disbursement would be in phases urged the beneficiaries to utilize the loans judiciously and refund on schedule.  Governor Fayose advised the Commissioner for Finance and Budget, Chief Toyin Ojo to collaborate with the banks that are involved in the loan scheme to ensure compliance.

CALL FOR FAYOSE’S RESIGNATION BY AD, MISCHIEVOUS  - EKITI PDP
 (08/08/06)
People’s Democratic Party (PDP) in Ekiti State, on Monday, dismissed the call for the resignation of Governor Ayo Fayose by the National Publicity Secretary of the Alliance for Democracy (AD), Prince Dayo Adeyeye, saying it was not only unnecessary but also mischievous.  PDP State Publicity Secretary, Alhaji Gani Bankole, in a chat with newsmen in Ado-Ekiti, wondered why the call when Governor Fayose is not on trial before any court of law.
Bankole said his party was not unaware of the orchestrated plan by the opposition of which AD is a member, to rubbish the Fayose administration through frivolous petitions to the Economic and financial crimes commission (EFFC) such that he (Fayose) would not be able to recontest so that the opposition can have a field day.   The Publicity Secretary however described the PDP as a party to beat in view of its popularity among the people and the monumental achievements of the Governor in the last three years.
Bankole who described AD as a dead Party in the State queried what it (AD) did when it had the opportunity of ruling the state for four years.  He said the AD needed to make the noise, no matter how empty it might be, to satisfy its paymaster in Abuja and Lagos and as such, create the impression that it is solidly on the ground in Ekiti.
The PDP chieftain however said that Ekitis are now wiser and have utterly rejected any move towards the dark days of the AD-led administration when they were living in abject poverty.  “The PDP government under the able leadership of Governor Ayo Fayose is not only prudent but has also performed excellently well to the admiration of the masses in the state.”
As at today, Bankole said the State has about N3.5 billion in its coffers, saying this was a demonstration of the fact that the Fayose administration has delivered on its electioneering promises to the people of the State.  To him, the antics of the AD towards the 2007 general elections was an exercise in futility.

GOV. FAYOSE WILL NOT SUCCUMB TO THE POLITICS OF BLACKMAIL (10/08/06)
Governor Ayo Fayose will not succumb to the politics of blackmail and pull him down syndrome embarked upon by detractors to prevent him from achieving his goal of transforming Ekiti to become a pace setter among states of the federation. The press secretary to Ekiti State Deputy Governor, Mr. Dipo Okunmuyide who gave this assurance in a statement issued in Ado-Ekiti said the governor has not lost focus of the need to pay attention to the execution of projects that will have direct bearing on the live of the people.
Citing the on-going construction of dedicated line from Ilesa sub station in Osun State to Ado-Ekiti as one of such efforts, Okunmuyide observed that the N120million project when completed will bring drastic improvement to the erratic electricity supply in the state capital and boost the economy of the people. He disclosed that the opposition are blackmailing Governor Fayose to prevent him from contesting in 2007 because they are jittery that Ekiti will witness total economic emancipation if the governor is given another chance, more so, he has recently put together a think tank to brainstorm on robust developmental plan to be adopted for another four years.
“It is glaring that inspite of low income in the state, Governor Fayose in less than four years has upgraded and created new infrastructure, especially road networks throughout the state and improved the standard of education through policies that allowed for continuity in learning and prevented strike actions by teachers,” he stressed.  Speaking further, Okunmuyide said at the moment, the state government is working on provision of two major road networks and over-head bridges in Ado-Ekiti to give it befitting stature of a state capital.

I’LL CONTINUE TO SUPPORT GOV. FAYOSE – OLUJIMI  (09/08/06)
Ekiti State Deputy Governor, Mrs Biodun Olujimi has pledged to continually support Governor Ayo Fayose in his current travails until the battle is won.  Mrs Olujimi nade the pledge during the presentation of a book tittled “Fayose’s saga – the true story” launched at the conference Hall, Governor’s Office, Ado-Ekiti.  The deputy Governor stated that no amount of detractors and opposition could make her betray a man who was instrumental to her appointment as the Deputy Governor of Ekiti State.
Mrs Olujimi who described Governor Fayose as a major factor in her rising political added that she would not relent efforts in supporting him. She urged the people of the state to shun the rumour making rounds the state that there is a division between her and the Governor saying that they would remain united and focused in the development of the state.
The deputy Governor who described the Governor as a goal getter and hard working man stated that the state has witnessed rapid development in the areas of education, agriculture, social amenities and road construction during Fayose’s administration.
She reiterated the determination of the present administration to embark at development projects aimed at putting smiles on the faces of the people despite the criticism from the oppositions.  Mrs Olujimi called on the people of the state to support Governor Fayose in his efforts to move the state forward.
She congratulated the author of the book, Honourable Oluwole Ogunlade, the Chairman, Ise Orun Local Government Areas for putting the book together for the benefit of people who are interested in truth and upliftment of Ekiti State.

Professor Orubuloye announced that boreholes have been sunk to ease the problem of water in the University adding that laboratories and administrative block would be constructed in a bid to transform the institution to world standard.

GOKE OLATUNJI’S ARREST, NO COURSE FOR JUBILATION (02/08/06)
Former Speaker of Ekiti State House of Assembly, Mr. Kola Adefemi, on Friday, said there was nothing to jubilate about over the current travails of Governor  Ayo Fayose’s Personal Assistant, Mr. Goke Olatunji. Adefemi, a chieftain of the People’s Democratic Party (PDP), in a chat with newsmen in Ado-Ekiti, the Ekiti State capital, said it was just a passing phase which did not call for any jubilation from the opposition and the critics of the Fayose administration.
Olatunji and a friend of the governor, Mr. Gbenga James are currently standing trail in a Federal High Court in Lagos for alleged money laundering. “There is nothing the opposition should jubilate about on this matter.  This does not translate into electoral victory for the opposition.  All we should do now is to watch the proceedings of the court.” The Former Speaker argued that Goke Olatunji, as a Personal Assistant to the Governor, is not in a position to withdraw government funds let alone looting the state treasury.
Adefemi said he was indeed “irritated and embarrassed” the way politics and politicking are being carried out in the state, saying the situation does not portend politicians as being serious. “I am irritated about how the opposition who want to take over power in 2007 in the state are going about their politics.” He condemned what he called undue sentiment, chaos, segregation, sectionalism and nepotism in the practice of politics in the state. Adefemi sued for politics without bitterness and mutual understanding among politicians in the state.

The Special Adviser said the construction of another 33KV dedicated feeder from Ilesa Transmission Station to Ado-Ekiti was in progress and would be completed in Setember this yaer, to improve electricity supply to the State capital.
Welcoming the Special Adviser, the Station Manager, Mr. Biodun Adesina, assured him of the station’s readiness to accommodate the expected increase in load due to the joining of Ikole consumers to the feeder.  He commended the State Government’s commitment in its bid to alleviate sufferings of the masses

WHY THEY’RE AFTER FAYOSE – ADEDIBU  (08/08/06)
The strongman of Ibadan politics, Chief Lamidi Adedibu has explained the reasons for the mounting opposition against Governor Ayo Fayose of Ekiti State, hinging it on the outstanding performance of the governor in the state in the last three years.  Adedibu, in a letter personally written to the governor dated 1st August, 2006, said his “unparalleled contributions” to the development of the state was the source of envy by his detractors.
The PDP chieftain said the detractors would have wished that their biological children were the governor with the attendant popularity that Fayose is enjoying among the people of the state.  “Your performance in office and glaring unparalleled contributions to the development of your state is a cause for concern and envy to your detractors who would have wished their biological children and no one else to be in your shoes. They forget that it is the good Lord that appoints and enthrones leaders”.  Adedibu further contended that what has offended Fayose’s critics most, thus engendering their envy, anger and annoyance, was his (Fayose’s) appointment as the chairman of the PDP Presidential Candidate Search Committee.
Adedibu who rained curses on the governor’s enemies prayed God to expose and destroy them even as he enjoined Fayose to continue in his noble and worthy deeds while awaiting the end of his detractors.   “I would like you to rest assured and be confident that you would sail through and triumph over your enemies. This is because the good Lord in His infinite mercy is with you. He would see you through, protect and guide you in your travails.  “The people of your state are solidly behind you and  are praying for your triumph and the Lord’s delivery over whatever evil plot your enemies might have woven for you.
Adedibu who pointed out that there is no problem that is insurmountable for God, said “I have, in this stead, asked my Mullahs and Alfas to engage in prayers on your behalf. I am also in prayer over this and I am certain God listens to prayers and that He would shower His mercy and protection over you and deliver you from the traps of evil men”.

ALUKO, EX-EKITI D-GOV NOT FIT TO CONDEMN POULTRY  PROJECT    -  ADELUSI (02/08/06)
The Chief Press Secretary to Ekiti State governor, Mr. Idowu Adelusi, at the week-end, told the former deputy governor, Mr. Abiodun Aluko to slump up, saying he lacks the moral right to condemn the execution of the controversial state poultry project. Aluko had, in a newspaper report, alleged that due process was not followed in the execution of the project, thus feeling vindicated in view of the latest development.
Adelusi who spoke in Ado-Ekiti, hinged Aluko’s tirade on the bitterness he is still harbouring over his removal in office. “Aluko can not say anything better than that because of the bitterness of his removal,” he (CPS) said, stressing that his statement that due process was not followed was totally false and unfortunate. “He (Aluko) lied about the due process.  Due process was actually followed in the award of the contract,” Adelusi insisted.
The Chief Press Secretary said Governor Fayose is not moved by the outburst of his former deputy and therefore remains unshaken. “At this period, the state government believes that silence is golden.  We are not prepared to join issues with anybody. “We see the attacks and harassments as the handiwork of the detractors of the Fayose administration.  It is a price we have to pay for leadership.  God will vindicate us.”
Adelusi contended that the mere fact that a person was arrested and arraigned in court does not mean that person is guilty until otherwise proven by the court. “Before the 2003 elections, it was tougher than this.  God vindicated us.
Even after the election, Fayose was taken to court over certificates. God still vindicated him.  We see this battle as of the Lord. We will come out victorious.”  “It is all about 2007.  They were given the ample opportunity by Ekitis to lift the state up but they failed woefully.  They never did anything to justify their mandate. “Now, Fayose is doing what they failed to do.  His achievements are physical and they are all over the place.  Their problem now is that all these things are happening from the man they had earlier written off. It really beats their imagination and they could not fathom it,” he stated.
